The Delhi High Court has notified Gopal Ansal, Sushil Ansal and other defendants in the Uphaar tragedy of evidence tampering and requested their response to a plea against the court’s order to reduce the sentence from seven years to eight months. This review request has been submitted by the Delhi Police. Justice Anup Jairam Bhambhani also sought a response from the Association of Victims of Uphaar Tragedy (AVUT) in this case. The court ordered all parties to submit their replies within four weeks and set the case for further hearing on April 13.

Police have challenged the July 2022 District and Sessions Judge’s order to release the convicts, arguing that the prison sentence awarded by the court is not only harsh and severe, but also disproportionate to the crime committed. Ansal was sentenced to seven years in prison by a magistrate in November 2021.

The request for review filed by AVUT against the order of the District and Session Judge is already pending in the Supreme Court. The Ansal brothers have also filed a petition to challenge their conviction in the case. Justice Bhambhani has now decided to deal with all petitions and appeals together. The judge also noted that given the age of those convicted in the case, the case should be heard at an appropriate time.
