The Delhi High Court said employers cannot insist that their employees be vaccinated against COVID-19. The court made this decision at the request of a government teacher seeking permission to teach without taking the Covid-19 vaccine.

Judge Pratibha M Singh granted the waiver allowing the petitioner to file representation with the relevant benefits authority and ordered a decision to be made within 30 days. At the same time, while closing all pending applications related to the case, the court said that the employer cannot insist on the vaccine.

The petitioner works as a history teacher and teaches classes XI and XII at the Government Girls Senior Secondary School in Delhi under the Director of Education Directorate of the Delhi Government.

She filed a petition in 2021 demanding she be allowed to attend school, teach and take on other responsibilities without being forced to take the COVID-19 vaccine.
